Cell Phone Pedestrian Accidents on the Rise

Apparently, the first “Text Messaging” pedestrian death was noted in a police report recently, but most cell phone and text messaging industry analysts do not believe it was the first. Rather, they believe it was the first one to be documented. You see, not everyone who is run over by a car is important enough for the police to investigate to see if they had been sending a text message at the time they were plowed into or mowed over.

Indeed, we all recall the recent commuter train accident where the conductor had ran a red-light, which was supposed to let a freight train through, and over 10-people died all because the conductor was text messaging and apparently did not see the red-light or was so distracted that he ran right through it. The rest was a mangled mess of flesh and steel. Tragic indeed, but it just goes to show that not everyone can walk and chew gum at the same time.

In California it is now against the law to drive and talk on the cell phone, and it is also against the law to text message while operating a motor vehicle. Still, when a young gal was text messaging recently and walked into traffic apparently oblivious to the approaching car, it was yet another reminder that cell phone pedestrian accidents are almost as likely as car or train accidents.

Now with the new Google Phone, with more features, thus, more distractions; will we see more pedestrian accidents? I mean if someone trips on a banana peel we can all laugh, but when they get hit by a delivery truck, no one is laughing then. Please consider this serious issue when using your cell phone. Posted on April 22nd, 2009 in Pedestrian Accident Information by admin

Pedestrian Accidents presents the following information regarding not only what kind of accidents and injuries can result from a pedestrian accident, but also how important a pedestrian accident attorney can be to the recovery process.

If you happen to get involved in a pedestrian accident, chances are; you will need the services of an accident lawyer to attend to your legal needs. And, in the event of an ill-fated injury, a knowledgeable accident lawyer will help speed up your recovery from injury and damages.

Overview and Statistics

Pedestrian accidents occur in more than one out of ten accidents involving automobiles. Pedestrians make up 11% of the total deaths caused by vehicle accidents. According to the National Highway Traffic Safety Administration, about 70,000 pedestrians die each year in automobile accidents which represents a startling 7 percent mortality rate.

Surprisingly, young children account for the highest number of casualty in pedestrian accidents while senior adults occupy the bottom of the list.

Here are the common causes of pedestrian accidents:

Speeding motorists

Inattentive motorist

Disobeying traffic signals

Motorists driving without regard to weather or traffic conditions

Driving while intoxicated

A victim of a pedestrian accident may suffer from the following injuries:

Broken or fractured bones

Permanent disability

Temporary incapacitation

Head injuries

Brain injuries and damage

Disfigurement

Mental distress and damage

Death

Pursuing a claim in pedestrian accident cases is a complex process which often involves a great deal of work. To better understand the nature of the work, here is a glimpse of how lawyers process a claim in a pedestrian accident case:

Conduct investigation and accomplish paperwork

Initially, your lawyer will hire an investigator to conduct probe on all aspects of the accident. He/She will take witnesses’ accounts and file a report. If necessary, he/she will hire experts to determine the degree of the culprit’s fault in the accident. These will include the gathering of all necessary documents, reports and bills that will support your claim. A lawyer will also see to it that special forms are accomplished by doctors and witnesses.

Monitor your medical treatment and care

Your lawyer will also monitor your medical treatment and if necessary, refer you to a health provider who will treat you on a lien basis if you have no medical insurance. Your lawyer will obtain a narrative report from the attending physician after your treatment.

Attend to your communications

Your lawyer will be responsible for communicating information to you through a secure email, fax, letters, court documents, and forms. These include correspondence from insurance companies and the court. He will also take on the tasks of responding to all letters and communications related to your case.

Represent you in negotiations

A lawyer will represent you in negotiating your claim with the insurance company. The process often involves placing a value for your claim and presenting it to your insurance company. If settlement becomes unsuccessful, your lawyer will begin litigation process.

Represent you in litigation

In case of an unsettled claim, a lawyer will act as your litigation attorney and help prepare your case for trial, mediation or arbitration.

Getting injured in a pedestrian accident is one thing; pursuing a claim from your injury is another matter. But in trying to recover from the loss and damages, it would be best to leave things to the care of a personal injury lawyer who has the experience in dealing with pedestrian accident cases.
